It would be difficult to revive a patent if it has lapsed. However the patent office has a procedure in place to restore lapsed patent subject to the approval of the patent office. The applicant / holder of a patent in Saudi Arabia should file a petition at the Saudi IP Authority at the patent department to restore a patent. The petition should include the reasoning for failure to respond to office actions issued or lapsed annuity settlements. This is not a straightforward matter, and it is at the discretion of the patent office whether to accept this petition or not. The process takes around 6 – 8 months and entails official and professional fees.
